MEDICAL CERTIFICATES AND THE BASIC CONDITIONS OF EMPLOYMENT ACT
The abuse of sick leave is costing employers millions if not billions of rands every year in South Africa. In order to address this, the core meaning of a valid medical certificate needs to be re-examined according to what the Basic Conditions of Employment Act says.
In order for a certificate to be valid it needs to meet two requirements, it must be issued by a registered medical practitioner and the medical practitioner must state in his or her opinion that the employee is incapable of performing his or her duties.
Other certificates are questionable and must be analyzed in terms of what the law says in order to qualify as valid medical certificates.
